The new Health and Safety at Work (Asbestos) Regulations 2016 came in to full effect as at the 4th April 2018.
The Regulation has been made under the Health and Safety at Work Act 2015 and therefore has relevance to Bodies Corporate formed under the Unit Titles Act 2010. WorkSafe is the regulatory body that is responsible for HSWA and the Asbestos Regulation.
If your Body Corporate does not have reasonable grounds to believe that asbestos is not present in your building, then it will be required to have an Asbestos Management Plan in place as at the 4th April 2018.
It seems from the legal advice that APM has received, that buildings constructed from 2000 onwards are less likely to have asbestos content in their construction. Many buildings constructed prior to the 1980’s are quite likely to have asbestos present and those built from the 1980’s to 2000 could also contain such materials.
The first step in taking action is to consult with your Body Corporate Manager. APM has taken a proactive approach and identified all of the buildings that we manage that were built prior to 2000 and we will be recommending that the Body Corporate consider commissioning an Asbestos Management Plan. This will form part of the agenda at your next Annual General Meeting or beforehand through the Owners Committee if you have a longer lead in time to your AGM.
